Huawei Reassures Licensing Commitment Regarding Certain IEEE standards (May 30, 2019)

Huawei hereby submits its licensing commitment to IEEE and to anyone who intends to practice the IEEE 802.11ax, 802.11ay, 802.11aj, 802.11ba, 1901.1 standards, as follows:

Huawei is committed to license its Essential Patent Claims with respect to the 802.11ax, 802.11ay, 802.11aj, 802.11ba, 1901.1 standards under Reasonable Rates in compliance with the IEEE-SA Standards Board Bylaws that came into effect on May 1, 2007 (“2007 Policy”) as the Letters of Assurance that Huawei has previously submitted to IEEE.

Huawei noted the IEEE-SA Standards Board Bylaws published on May 15, 2015 (“2015 Policy”) and its change from the 2007 Policy. Huawei considers it is difficult to predict whether the changes will render different level of protection for the underlying intellectual properties. For some standard projects, Huawei noted various IEEE members took the position their licensing commitment were in compliance with the 2007 Policy, while others submitted their licensing commitment in compliance with the 2015 Policy. As a primary contributor to the IEEE standards, Huawei believes fair treatment to standard contributors are essential to the thriving of IEEE standards.

The investment level of innovation varies among different technologies and return of such investment through IPR should also be varied accordingly. Huawei recognizes that diversified industries need diversified IPR policies. And specifically in the Wi-Fi area, Huawei is flexible to provide license to different levels of the supply chain in the industry including the chipset level on reciprocal basis.

Huawei looks forward to continuing its relationship with IEEE and furthering proliferation of product compliant with IEEE standards.
