Huawei UK 5G Experiential Series of Competitions (hereinafter collectively the ‘’Competitions’’ and individually a ‘’Competition’’) Terms and Conditions (the ‘’Competition Conditions’’)

Background

The Organiser (as defined below) will be conducting 10 separate Competitions between November and December 2019. These Competitions will take place at:

Cardiff University, University College London, University of Cambridge, Sunderland University, Edinburgh University, University of Sheffield, Middlesex University, Anglia Ruskin University, University of Kent and Manchester Metro University.  

1. Scope of application of these Competition Conditions:
1.1 By taking part in a Competition, the entrant accepts these Competition Conditions.

2. Organiser:
2.1 The organiser of the Competitions is Huawei Technologies (UK) Co., Ltd. (herein: “Organiser”).
2.2 This Competitions are not sponsored, endorsed or administered by, or associated with Twitter or any other social media or third party platform.

2.3 Entrants shall comply with the terms of service, community guidelines or other applicable policies for user submissions and/or uploads located at https://twitter.com/tos.

2.4 Competition submissions or entrants that violate the applicable terms of service or guidelines notified and available at https://twitter.com/tos shall be disqualified from the Competition which they enter.

2.5 Entrants entering a Competition release Twitter to the fullest extent possible under law from any claims whatsoever and howsoever arising.

2.6 All information regarding the Competitions is solely provided by the Organiser. In case of any questions, suggestions or complaint, please contact the Organiser via direct message at https://twitter.com/HuaweiUK.

3. Eligibility for entry into Competition:
3.1 The Competitions are open to all persons who, at the date of entry, are (1) aged 18 years or over; and (2) who is permanently or temporarily resident in the UK at the of the Competition.
3.2 The Organiser’s employees, their immediate family members, and employees of cooperation partners who are or were involved in creating or implementing the Competitions, are excluded from entering the Competitions.
3.3 Participation is only possible on one’s own behalf and joint submissions are not allowed. There is a restriction of one entry per person per Competition.

3.4 Entry to the Competitions is free of charge and no purchase is necessary; however, internet access is required.

4. Competition period:

4.1 Each Competition starts at 9:00am on the day on which it is opened by the Organiser and concludes at 11:59 pm of that day (the ‘’Competition Period’’).

5. How to enter:

5.1 Capture an image of yourself with the Organiser’s 5G Truck also in the image and post to Twitter, and;

5.2 Within the copy of the tweet tag @HuaweiUK and include the hashtag #5GisOn, and;

5.3 Follow @HuaweiUK.

5.4 Unless the requirements are met, any submission will be invalid.

6. Intellectual property rights:

6.1 Entrants must only submit images that are their own original work.

6.2 Entrants must not submit an image which has been previously published or won an award or prize via a promotion run by the Organiser or its affiliates anywhere in the world.

6.3 Entrants must only submit images and wording that does not infringe or violate any rights of any third party anywhere in the world, including but not limited to, ownership, copyrights, trademarks, patents, logos, licensing rights, rights of publicity or privacy or any other intellectual property rights howsoever arising.

6.4 The Entrant shall fully indemnify and hold harmless the Organiser and/or its affiliate(s) against any costs, damages, liabilities, losses or expenses (including legal expenses) incurred by Organiser and/or its affiliate(s) arising from any legal actions, claims or demands brought against Organiser and/or its affiliate(s) by any third party which states that Organiser’s and/or its affiliate(s), sub-contractors or agents possession and/or use of the images and/or wording (or any part thereof) entered into the Competitions by an entrant infringes any intellectual property rights of a third party.

7. Further Competition entry details:

7.1 All entries must be received by the end of the Competition Period to be valid and no liability is accepted for illegible, incomplete or late entries.

7.2 There is no limit to the amount of entries any one entrant can make save for the restriction at 3.3 above.

8. The Prizes:

8.1 One winner per Competition will receive Huawei FreeBuds wireless earphone pair (the ‘’Prize’’).

9. Winner Selection:

9.1 One winner will be selected at random by Organiser’s Mobile UK Communications Agency, BCW within 12 hours of the end of the Competition Period.

10. Winner Notification:
10.1The Organiser shall either publish or make available information that indicates that a valid award took place.

10.2 To comply with the obligation at 10.1, the Organiser will contact the winner by notifying the winner via Twitter (Direct Message) within 1 working day after the end of the Competition Period.

10.3 The winner must accept their Prize by responding to confirm eligibility and providing their full contact details, within 24 hours of receiving the notification described at 10.1 above.

10.4 In the event that a winner does not respond to the notification described at 10.2 above within 24 hours, the Prize will be forfeited. In this case, the Organiser reserves the right to award the Prize to a reserve winner selected in the same manner.

10.5 Reserve winners may have less time to respond but this will be made clear during the winner communication. Entrants who have not won a Prize will not receive a notification.
10.6 The winner will be responsible for any taxes, costs, expenses or charges incurred in claiming the Prize.
10.7 Prizes are subject to availability and the Organiser reserves the right to replace the Prize with an alternative prize of equal or higher value if circumstances beyond the Organiser’s control make it necessary to do so.
10.8 Compensation of the Prize in cash, its exchange, or its transfer to other persons are strictly excluded.
10.9 The Organiser does not accept any responsibility if the entrant is not able to claim or take up the Prize.

10.10 If the winner objects to any personal information and winning entry being published or made available, please contact the Organiser @HuaweiUK (on Twitter) or Huawei UK website: https://www.huawei.com/uk/contact-us#Media. In such circumstances, the Organiser must still provide the information and winning entry to the Advertising Standards Authority on request.

11. Moderation:

11.1The Organiser will reject entries which, in the sole reasonable opinion and discretion of the Organiser:

(i) contains any content that is offensive or could reflect negatively on the name, reputation, or goodwill of the Organiser or any brand partner;

(ii) includes trademarks, logos, or copyright material not owned by you or used without the rights owner's prior written permission (including famous names, company names, etc.);

(iii) defames, misrepresents, or insults other people or companies, including, but not limited to the Organiser (including its partners); and

(iv) promotes any political agenda

12. Limitation of Liability:

12.1 The Organiser, its affiliates and its associated agencies will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense or damage which is suffered or sustained (except where it is caused by the negligence of the Organiser or its associated agencies) in connection with the Competitions or accepting or using a Prize, except for any liability which cannot be excluded by law.

13. Miscellaneous:

13.1 The Organiser may refuse to award the Prize, or seek its recovery, from the winning entrant in the event of an entrant's fraud, dishonesty or non-entitlement under these Competition Conditions or otherwise.

13.2 All entries must be made directly by the person entering the Competition.

13.4 Bulk entries from trade, consumer groups or third parties will not be accepted.

13.5 Incomplete or illegible entries and entries which do not satisfy the requirements of these Competition Conditions in full will be disqualified and will not be counted.13.6 If an act, omission, event or circumstance occurs which is beyond the reasonable control of the Organiser and which prevents the Organiser from complying with these Competition Conditions the Organiser will not be liable for any failure to perform or delay in performing its obligations.13.7 The full name and social media handle the winners will be posted on @HuaweiUKTwitter handle after the winner is selected.13.8 Any personal data relating to entrants will be used solely for the purposes of this Competition by the Organiser and/or by any agent appointed by it to assist with running the Competitions on behalf of the Organiser and will not be disclosed to a third party for any other purpose. Entrants’ personal data will be handled in accordance with the Organiser’s privacy policy, available at: https://consumer.huawei.com/uk/legal/privacy-policy/.13.9 If any provision of these Competition Conditions is held invalid by any law, rule, order or regulation of any government, or by the final determination of any court of a competent jurisdiction, such invalidity shall not affect the enforceability of any other provisions not held to be invalid.13.10 By entering the Competition, entrants agree to be bound by these Competition Conditions.13.11 These Competition Conditions are governed by English law and shall be subject to the exclusive jurisdiction of the courts of England and Wales.13.12 The Competitions are brought to you by Huawei Technologies (UK) Co., Ltd.


Privacy Notice for the Competition

The Competitions are being provided by Huawei Technologies (UK) Co., Ltd (hereinafter referred to as "we", ‘’us’’ or "Huawei"). We are a company registered in England and Wales. We can be contacted by mail at 300 South Oak Way, Green Park, Reading, Berkshire, RG2 6UF or by email at UKIPrivacy@huawei.com.

1. How Huawei Collects and Uses Your Personal Information

Personal information means any information that enables Huawei to identify you as a user.

As part of the Competitions we will collect and use your personal data only for the purposes stated in this notice.

To operate the Competitions and provide the Prizes to the winner, we need to collect and process the following personal data:

  • Name for the purpose of selecting and contacting the winner
  • Postal address to send the Prize to the winner.
  • Ask the winner for permission to use the winning image for other purposes following the Competitions

We shall process this data for legitimate business interests and for administrating the Competitions.

You can always and at any moment object to such processing – please see section below ‘Your Rights as a Data Subject’.

Huawei will process the personal data you provide at entry to the Competitions in compliance with applicable laws and regulations (including GDPR and the Data Protection Act 2018).

Security and fraud control: we use the personal data you provide at entry to the Competitions to ensure compliance with the Competition Conditions.

If you fail to provide certain information to us, you may be prevented from participating in the Competitions.

2. Data Storage Location and Retention

Data Storage Retention Period:

We shall retain your personal data for no longer than is necessary to achieve the stated purposes and in any event for no longer than a for a period of 6 months from the closing date of the Competitions and will then be deleted unless there is a legal obligation to store it.

3. Transfer and disclosure:

Your personal data will be transmitted to employees of Huawei who are responsible for running the Competitions. We may also transfer the data in some cases to service providers who are directly involved in the Competitions as a partner or who are processing the data on our behalf. This includes using a third party to pick the winner of a Competition to ensure that the winners are randomly selected fairly. We shall put in place a data processing agreement with any third party that will act as a data processor. Your personal data will not be processed to third countries outside the EU/EEA.

3. Your Rights as a Data Subject

You have the following rights and choices:

The Competitions  may be promoted on third party platforms such as Facebook, Twitter and Instagram. This privacy notice does not cover your use of these platforms. You should instead refer to the privacy notice of the relevant platform operator.
