Statement Re: Huawei's Lawsuit Against Motorola Solutions in the US

[Shenzhen, China, January 26, 2011] Huawei has filed this lawsuit against Motorola Solutions because they stated their intention to transfer a significant amount of our intellectual property and trade secrets to Nokia Siemens Networks (NSN), which violates our existing licensing agreements. Huawei has licensed Motorola Solutions to access our intellectual property and trade secrets since 2000. However, Motorola Solutions has no right to transfer these intellectual property and trade secrets, which belong to Huawei, to any third party. As such, we are resorting to legal remedies to prevent this unauthorized transfer to ensure that our rights are not further infringed upon.

Since NSN announced its acquisition of Motorola Solutions' wireless network business in July 2010, Huawei has proactively communicated with Motorola Solutions to ensure that our intellectual property and trade secrets are not transferred to NSN. Regrettably, Motorola Solutions' actions have created a situation where Huawei is at significant risk of having our intellectual property and trade secrets infringed upon.

The unauthorized transferred by Motorola Solutions of our intellectual property and trade secrets to any third party will cause irreparable commercial losses to Huawei.
